Terms of Service
Terms of Service
These terms govern your use of Pine Island Passport (the “Service”), operated by Florida Passport. By using it, you agree to them. Effective August 23, 2026.
1. Who we are
Pine Island Passport is a community platform and marketplace for Greater Pine Island, Florida. We help people find local events, reunite lost pets, and connect with independent fishing guides and other local providers.
We are a venue, not the provider of the events, trips, or services listed here. Events are run by their organizers; charters and tours are run by independent captains and operators. We are not a party to any booking or transaction between you and a provider.
2. Eligibility
You must be at least 18 to create an account or book a paid service. By using the Service you confirm the information you give us is accurate.
3. Your account
Keep your password secure and your information current; you're responsible for activity under your account. Tell us promptly if you suspect unauthorized use. You can delete your account anytime — for captains, from your account page.
4. Captains & local providers
If you list as a captain or provider, you are an independent operator, not our employee, agent, or partner. You represent and warrant that you hold and will maintain all licenses, permits, and insurance required for your services (for captains, this typically includes a valid USCG license, the applicable Florida and federal permits, and liability insurance), and that your vessel and equipment are safe and legal.
You are solely responsible for your services, your customers' safety, your pricing, taxes, and compliance with all laws. We verify credentials as a convenience and may display a “Verified Captain” badge, but our verification is not a guarantee, endorsement, or assumption of responsibility for your services. We may suspend or remove a listing whose credentials are unverified, expired, or in question.
The captain tools (trip tracking, charts, route planning) are aids and recordkeeping only. They are not for navigation — the official charts and your onboard equipment remain the authority on the water.
5. Bookings & payments
When you book a provider, your agreement for that service is with the provider. Any payment terms, cancellation, no-show, weather, and refund policies are set by the provider and shown at booking. Where we process payments, we use third-party processors (such as Stripe); a booking fee may apply and will be disclosed before you pay.
Assumption of risk: boating, fishing, and outdoor activities carry inherent risks. You participate voluntarily and at your own risk, and your agreement with the provider may include additional waivers.
6. Your content
You keep ownership of what you submit (listings, reviews, photos). You grant us a non-exclusive, royalty-free license to host and display it for operating and promoting the Service. You're responsible for your content and confirm you have the rights to share it and that it isn't unlawful, infringing, deceptive, or defamatory. Reviews must reflect genuine experiences.
We may remove content or suspend accounts that violate these terms. To report content or an intellectual-property concern, contact us at the address below.
7. Acceptable use
Don't use the Service to break the law, infringe others' rights, post false or harmful content, scrape or overload our systems, or interfere with its operation or security.
8. Messages & email
If you give us your number or email, you agree we (and providers you contact) may message you about your requests and bookings. Marketing messages are only sent with the consent the law requires, and you can opt out anytime (reply STOP to texts, or unsubscribe from emails).
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind. We don't warrant that listings, credentials, charts, or other information are accurate, complete, or current, or that the Service will be uninterrupted or error-free.
10. Limitation of liability
To the fullest extent allowed by law, Pine Island Passport and its operators won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for the acts, omissions, services, or safety of any provider, organizer, or other user. Our total liability for any claim relating to the Service is limited to the greater of the fees we earned on the transaction at issue or $100.
11. Indemnification
You agree to indemnify and hold Pine Island Passport harmless from claims and costs arising out of your use of the Service, your content, your services (if you're a provider), or your violation of these terms or the law.
12. Governing law & venue
These terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. You agree that the exclusive venue for any dispute is the state or federal courts located in Lee County, Florida. We encourage you to contact us first so we can try to resolve things informally.
13. Changes & termination
We may update these terms; material changes will be posted here with a new effective date, and continuing to use the Service means you accept them. We may suspend or end access for conduct that violates these terms.
14. Sponsored listings
Some listings or events may be sponsored — meaning a business paid for the placement. When that is the case we identify it as “Sponsored” next to the item itself, not in a general notice, so you can tell which specific listing is paid for.
We use the single word “Sponsored” everywhere, and the label travels with the item: it stays attached in the calendar feeds you subscribe to, in the weekly email, on printed or shared posters, and anywhere else we syndicate the listing. Paid placement never changes the facts we publish about an event, and it is not an endorsement — the disclaimers in these terms apply to a sponsored listing exactly as they do to any other.
We may decline any sponsorship, and we may remove a sponsored listing that breaks these terms.
